Usage of Neon Alley (the "Service") is subject to the Terms of Use. To the extent this Membership Agreement (the "Agreement") conflicts with any provisions of the Terms of Use, this Agreement shall control.
Description of the Service
The Service is an Internet-based home entertainment service that provides access to a pre-programmed stream of video content including, but not limited to anime television programs and movies, live-action kung fu movies, music videos, and special interest programs (the "Content") through your Internet-connected device or television. Please direct all questions regarding the Service to neonalleysupport@viz.com. The Service is provided by VIZ Media, LLC ("VIZ Media").
Access to the Service
To gain access the Service, you must be enter a valid credit card, debit card, or other form of payment ("Payment Method") indicated on Neon Alley website at www.neonalley.com ("Website"). Once your Payment Method has been validated your account will become active ("Membership"). You may be eligible for a free trial.
Billing
By starting your Membership, you expressly authorize us to charge you a monthly membership fee at the then-current rate, together with any other fees you may incur in connection with your use of the Service and applicable taxes, to the Payment Method you provided during registration (or to a different Payment Method if you change your account information).
Please note that prices and charges are subject to change with notice, which we may provide via the Service, by electronic mail, by posting a notice on the Website or through other means. As used in this Agreement, "billing" shall indicate either a charge or debit, as applicable, against your Payment Method.
The membership fee will be billed when the paid portion of your membership begins and each month thereafter unless and until you cancel your membership. Visit the Website and click on the "Your Account" page to see the commencement date for your next renewal period. We automatically bill your Payment Method each month on the calendar day corresponding to the commencement of your paying membership. In the event your paid membership began on a day not contained in a given month, we bill your Payment Method on the last day of such month.
You acknowledge that the amount billed each month may vary from month to month for reasons that may include differing amounts due to promotional offers, and you authorize us to charge your Payment Method for such varying amounts. For certain Payment Methods, the issuer of your Payment Method may charge you a foreign transaction fee or related charges. Check with your bank and credit card issuers for details.
If you want to use a different Payment Method or if there is a change in Payment Method, such as your credit card validity or expiration date, you may edit your Payment Method information by visiting the Website and clicking on the "Your Account" link, available at the top of the pages of the Website. If your Payment Method reaches its expiration date and you do not edit your Payment Method information or cancel your account, you authorize us to continue billing that Payment Method and you remain responsible for any uncollected amounts.
If you are a first-time user of the Service, you may be eligible for one free week (7 days) of the Service, or as otherwise specified when you sign up for your Membership. To be eligible, your Payment Method must be authorized for up to approximately one month of service; however, no charges will be made against the Payment Method unless you do not cancel prior to the end of your free trial period. We may also periodically authorize your card in anticipation of membership or related charges. To view any specific details about your Membership, visit the Website and click on the "Your Account." The free trial may not be combined with any other offers. If you or another member of your household has opened a Membership within the last 12 months, you may not be eligible to receive a free trial.
Cancellation; Refunds; Credits
Your membership will continue month- to-month unless and until you cancel your membership or we terminate it. You must cancel your membership before it renews each month in order to avoid billing of the next month's membership fees to your Payment Method.
You may cancel your Service membership at any time. PAYMENTS ARE NONREFUNDABLE AND THERE ARE NO REFUNDS OR CREDITS FOR PARTIALLY USED PERIODS. To cancel, visit the Website and click on "Cancel Membership" on the "Your Account" page and follow the instructions for cancellation under the heading "Cancel Membership."
At any time, and for any reason, we may provide a refund, discount, or other consideration to some or all of our members ("credits"). The amount and form of such credits, and the decision to provide them, are at our sole and absolute discretion. The provision of credits in one instance does not entitle you to credits in the future for similar instances, nor does it obligate us to provide credits in the future, under any circumstance.
How Our Service Works
To become a member of Neon Alley you must have a PlayStation® 3 entertainment system with an active PlayStation® Network account, or an Xbox 360® game console with an active Xbox LIVE Gold Membership, with broadband access (minimum of 1Mbps).
We reserve the right in our sole and absolute discretion to make changes from time to time and without notice in how we operate the Service. Any description of how the Service works should not be considered a representation or obligation with respect to how the Service will always work. We are constantly making adjustments to our Service and often these adjustments are not completely captured within this Agreement and the Terms of Use.
The provision of the Service is subject to the availability and the operational limitations of the requisite equipment and associated facilities. You understand and agree that temporary interruptions of the Service, including VIZ Media's ability to stream the Service to you, may occur as normal events in the provision of the Service and that VIZ Media is not liable for such interruptions.
Device Access
You may stream the Service on up to 3 devices; however, the Service may not be streamed on the 3 devices concurrently. If you log in using your Membership ID and Password to one device and subsequently use the Service on a second device, you will automatically be logged out of the first device. To manage the devices dedicated to your Membership, go to "Your Devices" in the Your Account section on the Website. You are responsible for keeping your Membership ID and password confidential and you are responsible for all activity undertaken under your account, whether authorized or not.
Ratings & Parental Control
You must be the age of majority in your state of residence to become a member. While individuals under the age of majority may utilize the Service, they may do so only with the involvement and permission of a parent or legal guardian, under such person’s account and otherwise subject to this Agreement and our Terms of Use. The Service is not intended to be used by children, without involvement, supervision, and approval of a parent or legal guardian. The Service will generally provide TV ratings prior to each program so you can make an informed decision before watching the Content.
